Soup Athletica respects your right to privacy and is committed to safeguarding the privacy of our customers and website visitors.  We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth).  This policy sets out how we collect and treat your personal information.

The terms “we”, “our” and “us” refers to Soup Athletica (trading as soupathletica.com).  By using our services, you confirm you have read and understood this Privacy Policy and our Terms of Service and Cookie Policy.

In our Privacy Policy, when we refer to “you” or “your”, we mean those individuals who are customers and or website visitors of www.soupathletica.com.

We create, capture and publish unique stories of cycling adventure, community and triumph; to inspire our readers to get out in the great outdoors and reach athletic goals for good-times-sake.

We collect, use and disclose different types of personal information, depending on how you interact with us and the consents you provide. 

Personal information you provide to us directly

You provide us with personal information when you subscribe (or sign-up) to our newsletter, purchase a product or create a customer account.  

When you subscribe (or sign-up) to our newsletter, you provide us with the following personal information:

  • Email address

  • Marketing consent preference

When you add a product to your cart or create a customer account, we collect personal information to improve our checkout experience and customer service.  This information may include your:

  • First and last name

  • Email address

  • Shipping/Billing Address

  • Billing Information

  • Details about your order (e.g. your size)

  • Marketing consent preference

You may provide additional personal information at other times, including but not limited to, when you provide feedback, respond to surveys and/or promotions, seek service support or change your marketing consent preference.

Additionally, we may also collect any other information you provide while interacting with us. This may also include any personal information you may share with us in connection with promotions on our website, email or social media.

Other personal information we collect

We also collect, use and disclose your personal information to run our website effectively, analyse performance and power our site analytics provided by our hosting platform, Squarespace, such as:

  • IP address

  • Information about your browser, network or device (such as browser type and version, operating system, internet service provider, preference settings, unique device IDs and language and other regional settings)

  • Information about how you interact with our service (such as timestamps, clicks, scrolling, browsing times, searches, transactions, referral pages, load times, and problems you may encounter, such as loading errors).

This may also include personal information that relates to how you use and navigate through our website such as:

  • Page views

  • Timestamps

  • Clicks

  • Scrolling

  • Average browsing time

  • Searches

  • Load times and problems you may encounter (such as loading errors)

All information provided by our hosting platform, Squarespace, and is provided to us in an aggregated and depersonalised format. 

(3) How we collect your personal information

We collect personal information from you in a variety of ways, including when you interact with us electronically or in person, when you access our website and when we provide our services to you.

We may receive personal information from third parties. If we do, we will protect it as set out in this Privacy Policy.

(4) How we use your personal information

  • Provide our services. 

  • Communicate with you. Contact you directly by email with monthly newsletters, personalised communications about our services, website, digital publications or stories and communications about new products or services.  You can learn more about changing how we communicate with you in Section 6.

Abandoned cart emails

You’ll receive an automated email within 24 hours after you abandon your shopping cart, if all of the following occur:  

  • You enter your email address at checkout, or are logged into your Customer Account. You add a product which is in stock to your shopping cart. 

  • You close your browser or leave this website without completing your purchase. 

You can unsubscribe from these messages at the bottom of the email.  The email will link back to this website, where you can pick up where you left off and complete your purchase.

Marketing emails

We may send you marketing emails, which you can unsubscribe from by clicking the link at the bottom of the email. We share your contact information with Squarespace, our email marketing provider, so they can send these emails on our behalf.

Order and account emails

We may email you with messages about your order or account activity. For example, we may email you to tell you that:  

  • You’ve created a Customer Account 

  • Your Customer Account password has been reset or updated 

  • You’ve made a purchase 

  • Your order has shipped 

It’s not possible to unsubscribe from these messages.  We share your contact information with Squarespace, our website hosting provider, so they can send these emails to you on our behalf.

Shipment tracking messages

When you provide your contact information, such as your email or mobile number at purchase, you’ll automatically get tracking notifications from Sendle, our shipping provider.  You may receive these messages to your email, mobile or both.  This will include a delivery estimate so you know approximately when the parcel will arrive. We also include a tracking link so you can track the parcel along the way.

It’s not possible to unsubscribe from these messages.  We share your contact information with Sendle, our shipping provider, so they can send these emails to you on our behalf.

  • Maintaining and improving our services.  Understand how our services are accessed and used to evaluate and improve our Services (including by developing new products and services and managing our communications) and monitor and measure the effectiveness of our advertising. We usually do this based on anonymous, pseudonymised or aggregated information, provided to us by our hosting platform Squarespace, which does not focus on your use of our services individually.

  • Security. Ensure the security and integrity of our website.

  • Complying with law. Comply with applicable legal requirements, such as government regulations and industry standards, contracts and law enforcement requests.

We process your personal information for the above purposes when we have:

  • Consent. You have consented to the use of your personal information in a particular way. When you consent, you can change your mind at any time. 

  • Legal obligation. We have a legal obligation to use your personal information, such as to comply with applicable government regulations or to comply with a court order or binding law enforcement request.

(5) Disclosure of your personal information

We may from time to time need to disclose personal information to:

  • Comply with the Law.  We may disclose your personal information if we determine that such disclosure is reasonably necessary to comply with the law, protect our or others’ rights, property or interests or prevent fraud or abuse of Soup Athletica or our readers.

  • Protect our interests.  We may also use your personal information to protect the copyright, trademarks, legal rights, property or safety of Soup Athletica, www.soupathletica.com, its customers or third parties.

Third Parties

We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this Policy.  Personal information is only supplied to a third party, such as our hosting platform Squarespace, when it is required for the delivery of our services.

For example, our website is hosted by Squarespace.  Squarespace collects personal data when you visit our website, such as: Information about your browser, network and device, Web pages you visited prior to coming to this website and your IP address.  Squarespace needs the data to run this website, and to protect and improve its platform and services. Squarespace analyses the data in a de-personalised form.

Information that we collect may from time to time be stored, processed in or transferred between parties located in countries outside of Australia.  These may include, but are not limited to the United States of America.

Sale or Transfer

If there is a change of control in our business or a sale or transfer of business assets, we reserve the right to transfer to the extent permissible at law our user databases, together with any personal information and non-personal information contained in those databases.  This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. We would seek to only disclose information in good faith and where required by any of the above circumstances.

By providing us with personal information, you consent to the terms of this Privacy Policy and the types of disclosure covered by this Policy.  Where we disclose your personal information to third parties, we will request that the third party follow this Policy regarding handling your personal information.

If you no longer wish to receive email communications from us, you can contact us at hello@soupathletica.com at any time to opt-out, or follow the opt-out instructions provided in the email communication.

You may request details of personal information that we hold about you in accordance with the provisions of the Privacy Act 1988 (Cth).  A small administrative fee may be payable for the provision of information. 

If you would like a copy of the information, which we hold about you or believe that any information we hold on you is inaccurate, out of date, incomplete, irrelevant or misleading, please email us at hello@soupathletica.com.

We reserve the right to refuse to provide you with information that we hold about you, in certain circumstances set out in the Privacy Act.

If you have a complaint about our handling of your personal information, please contact at hello@soupathletica.com. 

How we manage complaints

Once we become aware of a privacy complaint, we will:

  • promptly acknowledge your complaint, 

  • determine if it requires further action, 

  • carefully investigate it and determine the steps that we will undertake to resolve your complaint, and

  • contact you if we have any further information and provide you with our determination once it is made.

(9) Changes to Privacy Policy

Please be aware that we may change this Privacy Policy in the future.  We may modify this Policy at any time, at our sole discretion and all modifications will be effective immediately upon our posting of the modifications on our website or notice board.

Our site may from time to time have links to other websites not owned or controlled by us.  These links are meant for your convenience only.  Links to third party websites do not constitute sponsorship or endorsement or approval of these websites. 

Please be aware that Soup Athletica is not responsible for the privacy practises of other such websites.  We encourage our users to be aware, when they leave our website, to read the privacy statements of each and every website that collects personal identifiable information.
